한국 긴급중재인 제도에 대한 소고 : 집행문제를 중심으로

초록/요약
중재판정부가 구성되기 전에도 보전조치를 취할 수 있는 긴급중재인 제도는 국제중재를 더욱 효율적으로 만들었다. 집행가능성을 떠나서 긴급중재인의 결정을 당사자가 이행하지 않는 것이 중재판정부가 구성 된 뒤의 본안에서 불리하게 작용할 여지가 있을 것이라는 심리적인 부분 때문에 긴급중재인 제도는 비교적 효과적으로 운영된다. 그러나 지속적인 성장에도 불구하고 집행력에 대한 의심이 궁극적인 제도 수용에 제한을 가하고 있다. 우리나라도 최근에 국제중재규칙으로 긴급중재인절차를 받아들였으나 집행력에 대한 불명확성 문제를 여전히 가지고 있다. 한국에서 긴급중재인의 결정이 효과적으로 이루어지려면 국내 사법시스템 하에서 집행이 가능하도록 국내법이 적절히 규정되어 있어야 한다. 가령 싱가포르는 중재법에 중재판정부의 정의를 넓혀서, 홍콩은 긴급중재인이 내린 보전조치가 홍콩 내외에서 승인 및 집행이 가능하다는 내용의 Part A를 중재법에 삽입함으로 해결하고 있다. 우리나라도 중재법을 개정하여 긴급중재인을 중재판정부의 정의에 포함시키고, 긴급중재인의 결정이 집행력이 인정된 임시적 처분과 같은 효과가 있으며, 뉴욕협약에서 요구하는 최종성이 인정된다는 연결 규정을 제정할 필요가 있다. 이를 통해 분쟁당사자들은 우리나라를 중재친화적인 국가로 인식할 것이며 중재 중심지로 도약할 수 있을 것이다.

Last year, an emergency arbitrator procedure in accordance with the international arbitration rule has been finally adopted in Korea, a decade after its introduction. Arbitral institutions provide interim measures in the course of tribunal proceedings to avoid litigation in open court that is often expensive and time-consuming. An emergency arbitrator procedure offers an urgent relief prior to the constitution of an arbitral tribunal, thus enhancing the speed and effectiveness of the arbitration procedure even further. Although most of the arbitral institutions interpret that the emergency arbitration rulings are binding on the parties, enforcing the emergency arbitration provisions have some difficulties in practice, and it is not clear whether or not arbitral interim measures will be enforceable under the newly-adopted provisions in Korea. In this study, experiences in other countries are explored in seeking for the possible problems and solutions of enforcing the emergency arbitration rulings. For example, Singapore, Hong Kong, and U.S insert terms such as ‘finality’, ‘enforceable in the same manner as an order or direction of the Court’, ‘Same effect as an arbitral tribunal or interim measures’ in their emergency arbitrator legislation to enhance enforcement.
