대상판결은 기타공공기관이 조달청에 대한 요청조달계약을 위탁한 경우에 부정당업자 입찰참가자격제한처분의 근거법률과 처분권한의 귀속주체가 문제된 것이다. 이에 대하여 서울고등법원은 계약의 당사자는 피고 조달청과 원고 계룡건설산업회사이므로 국가계약법이 적용되며, 따라서 국가계약법 제27조에 의거하여 중앙관서의장인 조달청장이 입찰참가자격제한처분을 내릴 수 있다고 판단한 반면에 대법원은 조달청은 부산대학교 병원으로부터 계약체결을 요청받아 그에 따라 계약업무를 이행한 것에 불과하므로 조달청장이 부산대학교 병원을 대신하여 국가계약법 제27조의 입찰참가자격제한처분을 발급하기 위해서는 수요기관인 부산대학교 병원으로부터 그에 관한 업무위탁에 법률상 근거에 따라 처분권한을 위탁받아야 하는데 그러한 법적 근거가 없어 조달청장은 입찰참가자격제한처분의 권한이 없다고 판단하였다. 이러한 대법원 판결은 공법영역에서 법률유보원칙을 강조하여 국민의 기본권을 보장하는데 일조하고 있으나 기타공공기관의 부정당업자제재조치의 법적 성격에 관하여 명확한 입장을 표명하고 있지 않다는 점에서 약간의 미흡함이 남는다.

In this case the problem ist the legal grounds and subject of disposition of restriction of prequalification to an unlawful person in the request procurement contract. The Appeal of Court judged that the parties to the contract are the defendant Public Procurement Service (PPS) and the plaintiff Kyeryong Construction Industry Co. and accordingly, the Chief Prosecutor of the central office, under Article 27 of the National Contract Act, could issue a right of disposition of restriction of prequalification to an unlawful person. But the Supreme Court concluded that the parties to the contract are the other public agency, Pusan National University Hospital and Kyeryong Company and the PPS is only an assistant in the contract. Therefore, according to the aims and provisions of Operation of Public Institution Act the Chief Prosecutor of PPS has no authority to dispose of the bids without legal grounds. The Supreme Court ruling emphasizes the Principle of Legal Reservation (Gesetzvorbehalt) in the area of public law, which is helping to guarantee the fundamental rights of the people, but it remains a bit lacking in that it does not express a clear position on the legal nature of disposition of restriction of prequalification to an unlawful person by the other public agency
