초록/요약
With the storming Fourth Industrial Revolution in Korea, Professor Cheonsoo Yang has published a book, titled The Fourth Industrial Revolution and Law(Pakyoungsa, 2017). This article attempts to offer a detailed review of the book. Indeed, this book has some defects. Above all, being a manuscript of scholarly research, the book is largely preliminary and less organized. And the book sometimes describes and exposes the same concepts and theoretical background repeatedly, which might degrade the value of the book as a manuscript as opposed to a collection of journal articles. Moreover, the book is at large ‘explanatory’ rather than ‘argumentative,’ and sometimes makes overgeneralization without strict arguments. Yet this book deserves the label ‘challenge,’ both because the topic has a high entry level, and because the relevant research in the academia has not yet been full-blown. In my knowledge, the book is the first manuscript in our academia in Korea to address the drastic technological change driven by artificial intelligence, robots, big data and the fourth industrial revolution―in the dimension of law and jurisprudence. The book has indeed made a daring challenge unprecedented at least in Korea. This is why the book deserves a high praise if it has not come a long way to its goal.

우리 사회에 제4차 산업혁명이라는 광풍이 부는 가운데, 영남대학교 법학전문대학원의 양천수 교수가 저술한 제4차 산업혁명과 법(박영사, 2017)이 나왔다. 본고에서 필자는 이 책에 대한 상세한 서평을 시도한다. 이 책에는 몇 가지 아쉬운 대목이 발견된다. 우선 이 책은 단행본 학술연구서로서는 많은 내용이 시론적이고 덜 조직화된 감이 있다. 그리고 동일한 내용이 두 번 이상 중복되는 대목이 종종 눈에 띄는데, 이 점은 본서가 ‘단행본’으로서 가질 가치를 다소 해칠 법하다. 뿐만 아니라, 이 책 내용은 전반적으로 ‘논증적’이기보다는 ‘설명적’인 듯한 인상을 주며, 엄밀한 논증을 생략한 채 과도하게 일반화한 듯한 대목도 종종 보인다. 그러나 이 책은 무엇보다 ‘도전’이라는 말에 어울리는 시도이다. 그 주제가 가진 높은 진입장벽을 생각할 때, 그리고 관련 학계의 연구가 아직 전반적으로 무르익지 않았음을 볼 때 그렇다. 필자가 알기로, 이 책은 우리 법학계에서 인공지능과 로봇, 빅데이터, 그리고 제4차 산업혁명 등으로 대변되는 급진적인 기술적･사회적 변화를 법학의 차원에서 다룬 최초의 단행본이다. 저자는 적어도 국내에서 미증유의 어려운 길을 과감히 나선 것이다. 그래서 그 첫걸음은 반가운 일이고, 비록 아직 길을 멀리 가지 못했을지라도 그 걸음은 마땅히 상찬 받을 일이다.
