학교폭력의 범위 및 가해학생과 그 감독자의 법적 책임에 관한 고찰 : 미국의 법제와의 비교를 중심으로

초록/요약
우리나라에서 학교폭력으로 인하여 미성년자인 피해학생이 자살을 하거나 살해를 당하는 사건이 최근에도 수차례 발생하였다. 학교폭력의 양상은 저연령층으로 확대되어 가고 있고, 잔혹해지고 있으며, 대상자가 학생 외에도 교사, 교직원에까지 이르고 있다. 우리나라는 학교 내에서 발생하는 폭력에 대한 특별법으로 ｢학교폭력예방 및 대책에 관한 법률｣을 제정하여 시행중에 있다. 이 외에도 민법에 의한 불법행위책임, 형법 각조에 의한 책임 등 가해학생과 그 감독자의 책임이 규정되어 있다. 미국의 경우 다양한 인종과 민족으로 이루어진 국가이기에 이들 간의 갈등이 학교 내에서도 학교폭력으로 나타나기도 하고, 일부 주에서는 총기를 사용한 학교폭력이 다수의 사상을 가져오는 사건도 발생하고 있다. 그러한 이유로 미국의 각 주는 학교폭력에 대하여 각별한 관심을 가지고 있으며, 학교폭력의 유형이나 그에 대한 제재, 대상학교의 범위나 대상자의 범위의 확대에 대해서도 다양한 시도를 하고 있다. 이에 미국의 여러 주 중 따돌림방지법의 특수한 법제를 가지고 있는 조지아 주, 뉴욕 주, 캘리포니아 주, 노스캐롤라이나 주의 내용을 살펴보고자 한다. 우리나라와 미국의 위 각 주의 법제를 비교할 때, 미국의 경우 학교폭력의 새로운 유형을 정의하고 있고, 학교와 학생, 그리고 피해자의 범위를 넓히는 현상이 있다는 점, 가해학생과 그 감독자의 책임에 있어서 경우에 따라 형사적 처벌에 대해서도 특별법에서 논의하고 있다는 점 등이 그 차이점이라고 할 수 있다. 우리나라의 학교폭력의 양상이 심각해지고 잔인해지는 점을 감안할 때, 미국 각주의 학교폭력에 관한 법제에서 논하고 있는 다양한 개념 정의와 대상 범위의 확대, 가해학생과 그 감독자에 대한 제재 방안 등을 검토할 필요가 있다고 생각한다.

In Korea, there have been many cases of suicide or killing of a student who is a minor because of school violence. The aspect of school violence has been expanding to the younger generation, becoming more cruel, and reaching teachers, faculty and staff as well as students. As a countermeasure against violence occurring in schools, Korea has enacted ｢the Law on the Prevention and Countermeasures against School Violence｣. In addition, liability of illegal acts by civil law and liability of students and their supervisors, such as liability by each criminal law, is prescribed. In the United States, it is a nation of diverse races and ethnic groups. Conflicts between the races are often seen as school violence in schools. In some states, individuals are able to carry firearms and it causes school violence using firearms. For that reason, states in the United States have a particular interest in school violence. So they are also making various attempts to expand the scope of the schools targeted and the types of school violence, sanctions, and targets. I would like to take a look at the contents of Georgia, New York, California, and North Carolina, which have a special legal system of bullying prevention law. The United States defines a new type of school violence, broadens the range of schools, students, and victims, and sometimes criminal penalties are also discussed in specific laws in the case of students and their supervisors. Given the seriousness and cruelty of school violence in ourcountry, it is necessary to review the various concept definitions and broader scope of subjects.
