초록/요약
본 연구의 목적은 장애등급제 폐지에 따른 서비스 제공절차에 대한 법적 기반을 고찰하는 것이다. 장애등급제는 장애인복지를 설계하고 시행하는 데에 있어 기본 체제적 성격을 가지고 30년간에 걸쳐 시행되어 왔으므로 이를 폐지하고 대안적 체제를 정비하기 위해서는 상당한 진통과 시간이 소요될 것이다. 장애등급제가 영향을 미치는 다양한 제도 중에서 본 연구는 서비스 제도에 대한 내용 검토를 통해 현행의 장애등급제가 폐지된 이후의 법적 절차에 논의하고자 하였다. 논의 결과 장애등급제 폐지 이후에 현행 서비스 제공절차를 유지한다 하더라도 서비스 제공영역에서의 심대한 혼란은 발생하지 않을 것으로 예측되나, 법적 불안정성이 지속되므로 장애등급제 폐지의 의미와 목표를 달성하기 위해서는 현행의 서비스 절차를 개편하여 법적 기반을 보다 충실히 할 필요가 있는 것으로 나타났다. 법적 정비방안은 장애인이 필요로 하는 서비스에 대한 욕구파악 그리고 이를 토대로 한 서비스계획의 수립과 수립된 서비스계획이 이행될 수 있도록 장애인과 서비스 제공기관과의 연계가 핵심이 될 것으로 파악되었다. 이러한 법적 정비 방안에 대한 단초는 이미 현행 법률인 장애인복지법과 발달장애인복지법을 통해 확인할 수 있었으며, 앞으로 장애등급제 폐지와 더불어 이러한 일련의 서비스 절차를 전체 장애인에게 적용될 수 있는 법적 근거를 마련해야 할 것이다. 이것은 장애등급제의 폐지가 폐지 자체가 목표가 아니라, 동 제도가 장애인복지와 관련하여 중대한 영향을 미치고 있음을 인식하고 장애인에 대한 서비스 제공에 있어서의 새로운 시각이 도입되어야 함을 의미한다. 현재와 같이 장애인을 복지 및 시혜의 대상으로 바라보고 장애등급에 따라 행정적 편의 절차에 따라 일방적인 지원을 하는 시스템이 아니라 장애로 인해 불편을 겪는 장애인의 개별적 상황을 고려하고 장애인이 일상생활에 제약을 받지 않도록 법적 절차를 정비함으로써 장애인의 인간다운 삶을 보장하도록 노력해야 함을 말한다고 할 것이다.

This study aims to explore the revision of the legal service process due to abolition of grade of disabilities. The grade of disabilities plays a role in operation system for welfare for people with disabilities for about 30 years and thus makes considerable effects on related welfare scheme for the people. Among various schemes, this article focuses on the development of services process in terms of the legal foundation. It is expected that abolition of grade of disabilities does not make critical influences on service process although the current process stays as it is. However, the current legal service process will be instable, it needs to be revised along with abolition of grade of disabilities. The key process to be amended will be three steps: first, needs assessment, second, service planning based on the assessment and service reference between people with disabilities and service providers. It is found that the possibilities of the legal revision will be made throuhg the investigation of current acts, especially both Act on the welfare for people with disabilities and Act for people with developmental disabilities. Those have already the legal process of the three steps for people with developmental disabilities mentioned above. After abolition of grade of disabilities, the introduction of legal service process will be helpful that people with disabilities lead a ordinary life as a human in society.
