개성공단 사업과 금강산 관광 재개를 위해서는 미국의 대북제재 체제는 물론이고UN 안보리 결의 내용들과의 충돌을 막기 위한 방안을 마련하는 것이 필요하다. 우선, 개성공단 재개를 위한 투자보장이나 금융보험서비스나 설비를 구축하기 위해서는결국 이를 금지하고 있는 안보리 결의 위반을 막기 위해 안보리 대북 재재 위원회의구체적인 사안별 승인을 거쳐야 할 것이다. 또한, 벌크 캐시(bulk cash)의 북한 유입을 제한하는 안보리 결의를 피해가기 위해서는 금강산 관광의 대가나 개성공단에서지급하는 임금을 과거의 현금 지급이 아닌 현물 지원 방식으로 전환하는 방식을 생각해볼 수 있다. 현물 지급이 합의되기 곤란하다면, 개성공단 및 금강산 관광사업을 통해 북한에 지급되는 현금의 전용 가능성을 확실히 차단할 수 있는 제도적 장치(자금의 흐름을 검증할 수 있는 시스템 구축 등)에 남북한이 합의하는 방안도 고려해볼 수있다. 또한 금강산 관광에 필요한 시설 보수와 인프라 건설을 추진하기 위해, 북한과의 합작투자와 투자 확장을 금지하고 있는 안보리 결의의 예외로도 승인해줄 것을 위원회에 요청할 수 있을 것이다. 물론 관련 안보리 결의 조항들을 개정하거나 폐지하게 되면, 위와 같은 문제점들이입법론적으로 해소되게 되므로, 이를 위한 외교적 노력도 전개될 수 있다. 시스템적으로도 중국·러시아·일본·미국 등 다국적 컨소시엄이 사업에 참여하여 남북 경제 및관광사업의 지속성, 사업인력의 안전 보장, 한반도에 이해관계가 있는 국가 간 이해와 협력을 증진하는 방안이 강구될 수 있다. 이런 모든 노력들은 북한의 진정한 비핵화 노력이 소정의 결실을 거두고, 한반도 주변 이해관계국들의 협력 의지가 발휘될 때, 국제사회에서 의미 있게 수용될 수 있게 된다.

In order to resume the Kaesung Industrial Complex project and Kumkang Mountain Tour program between the South and North Koreas, we need to find ways to prevent any conflicts with UN Security Council resolutions and the U.S. unilateral sanctions against the North Korea. Any investment protection mechanism and establishment of banking and insurance service infrastructure in the North Korean territory will necessitate an approval of case-by-case exemption by the Committee (North Korean Sanction Committee). Also, to avoid violations of Security Council Resolutions that restrict infusion of bulk cash into the North Korean territory, any payment under the Kumkang mountain tourism or Kaesung Industrial Complext project may be made in the form of in-kind instead of cash payment. If in-kind payment is not feasible, the South and North Korean governments may be agreed to establishment of verifying system that can prohibit any possibility of misuse of cash payment by the North Korean government. Requests of Committee exemption from Security Council Resolutions forbidding joint investment and expansion of investment in the North Korea may also be needed for renovation of facilities and infrastructure in the Kumkang Mountain area. Of course, all the above problems may be resolved through revision or abolition of the relevant Security Council Resolutions. Therefore, diplomatic efforts can be made for this possibility. Participation of multi-national consortium including China, Russia, Japan, and America in the project and program may be needed to enhance sustainability and continuity, security protection for human resources, and cooperation among interested states. All these efforts will be meaningfully responded by the international community, only if the North Korea were to produce results of denuclearization and interested states around the Korean peninsula to share the genuine spirit of cooperation.
