A study on the reform of laws related to work-family balance from the perspective of gender equality

Reinforcing support system for the work-family balance does not necessarily guarantee gender equality. According to the current law, the establishment and direction of the gender equality perspective in the work-family balance support system seems insufficient and there is also a tendency to approach the problem of work-family balance mainly from the perspective of women’s issues and family policy. However, it is important to reflect the gender equality perspective in that work-family balance or work-life balance is an important issue for both men and women. With this awareness of a problem, it is necessary to improve the legal system and terminology related to work-family balance support. Above all, the prohibition of discrimination based on family responsibilities such as childcare or familycare and improvement of the relief system, transformation of the working time system in which men and women can share responsibilities and enjoy time sovereignty, and expanding the scope of application for universal application of maternity and parental leave should be promoted. Gender equality in the legal system for work-life balance will be realized through a system that supports the pursuit of human dignity and happiness while balancing the time that both men and women spend for work and time for family or private life.
