이 글은 한국사회에서 업무상 이유로 인한 태아건강손상이 산업재해로 인정되는 과정에서 재생산건강과 노동안전보건의 문제가 통합되는 것이 아니라 다시 기존의 모성 보호담론으로 회귀하게 되는 한계를 비판적으로 분석한다. 2023년 1월 시행을 앞두고 있는 소위 태아산재법은 2012년부터 십여 년간 이어진 제주의료원 간호사 태아산재 인정 소송의 결과이다. 유산, 불임, 건강손상자녀 출산과 같은 재생산건강의 문제는 남성 중심적으로 구성되어 온 노동안전보건 법제도에서 배제되어 왔으며 업무상 재해로 인정되지 않았다. 하지만 역설적으로 태아산재가 법적 인정을 받게 된 현재 상황에서는 그 적용 대상이 ‘임신 중인 근로자’로 한정됨에 따라 남성노동자의 재생산건강의 문제는 업무상 재해로 인정되지 못한다. 이 글은 기존의 노동안전보건과 모성보호의 문제를 다뤄온 법제도들 속에서 노동하는 몸과 재생산하는 몸이 어떻게 다르게 구획되고 보호 되어 왔는지를 살펴본다. 이를 바탕으로 제주의료원 태아산재 소송에서부터 태아산재 법 제정까지 여성노동의 특수성과 모체-태아의 관계가 태아산재 인정의 필요성을 뒷받 침하는 주요한 정당화 논리로서 사용되어 왔음을 밝힌다. 이 글은 태아산재 문제를 근본적으로 해결하기 위해서는 모성보호강화를 넘어 생산과 재생산의 오래된 이분법에 대한 문제제기가 이루어져야 하며, 동시에 재생산건강의 문제가 여성노동자만의 예외적 문제로 제기되는 것이 아니라 모든 노동자의 보편적 재생산건강의 문제로 제기되어야 함을 주장한다.

This article critically examines South Korea’s legal recognition of congenital disabilities in newborns as an industrial accident. Because the present rules have prioritized safeguarding the health and safety of male workers, reproductive health problems, including miscarriage, infertility, and birth deformities, have not been acknowledged as important workplace health threats. In 2012, however, the nurses who gave birth to children with birth defects as a result of their work environment filed a lawsuit seeking legal recognition of fetal industrial accidents. It led to the 2022 amendment of the Industrial Accident Compensation Insurance Act, which now includes birth defects as an occupational accident. By examining the legal debates surrounding birth abnormalities caused by the workplace, this article analyzes why and how male workers’ reproductive health issues have been disregarded and forgotten in the discourse when they could also affect birth defects. It argues that birth defects should be problematized as all workers’ reproductive health difficulties in order to fundamentally address the issue of fetal disease, injury, and other health problems outside the framework of maternal protection.
