이 연구는 전부개정된 지방자치법의 시행을 계기로 지방자치 기관구성의 다양화 가능성과 이와 관련된 쟁점들, 그리고 지방자치 활성화를 위한 조건들을 검토하였다. 전부개정된 지방자치법의 시행으로 지방정부의 기관구성을 다양화할 수 있는 법적 근거가 마련되었고, 지역의 특수성과 지역 주민들의 의지를 반영하여 지방자치가 이루어질 수 있는 제도적인 길이 열렸다. 실질적인 지방자치 활성화를 위해서는 주민들과 지방의회, 그리고 자치단체장이 함께 지역의 현실에 맞는 기관구성의 대안들을 논의할 수 있는 장이 마련되어야 한다. 더불어 지역의 자율성이 최대한 발휘될 수 있도록 가능한 절차와 범위를 추가적인 법제도의 마련을 통해 뒷받침하는 것도 중요하다. 기관구성에 관한 별도의 특례 규정을 신속히 마련하고 이를 각 지방자치단체들이 참고할 가이드로 활용함으로써 제도변화의 논의와 과정에 있어서 불필요한 논란을 방지할 필요가 있다. 또한 지방자치법 전부개정을 통해 기대하는 지방정치의 강화는 선거제도의 다변화와 함께 지역정당이 활성화될 때 비로소 이루어질 수 있다. 정당설립의 규정 개정은 반드시 필요하나, 지역정당 활성화의 충분조건이 되지는 못한다. 한국 선거제도의 비례성이 다른 OECD 국가들이 채택하고 있는 선거제도보다 확연히 낮기 때문이다. 한국에서 지역정당이 활성화되기 위해서는 느슨한 형태의 정당창당 요건 개정과 더불어 선거의 비례성을 높이는 방향으로 선거제도 개편이 이루어져야 한다

With the enforcement of the new Local Autonomy Act, this article examines the possibility of diversifying the composition of local government and conditions for revitalizing local politics. The new Local Autonomy Act provides the legal basis for diversifying the organization of local government and the institutional path for activating local politics. In order to activate local politics, a forum should be prepared where residents, local councils, and heads of local governments can discuss alternatives for the organization that fit the reality of the region. In addition, it is important to support the possible procedures and scope through the additional legislation to guide the local community to set up its government. It is necessary to prevent unnecessary controversy in the discussion and process of institutional change. More importantly, the strengthening of local politics expected through the new Local Autonomy Act can only be achieved when the local political parties are activated along with the diversification of the electoral system. Revision of the rules for party establishment is essential, but it is not a sufficient condition for revitalizing local political parties. This is because the proportionality of the Korean electoral system is significantly lower than that of other OECD countries. In order to revitalize local political parties in Korea, the reform of the local electoral system should be carried out in the direction of increasing the proportionality of the election and party establishment requirements need to be loosened.
