본고는 2022년 행정법 각론 분야에서 선고된 대법원 판결 가운데 법률실무나 학계에서 주목할만한 판례 9건을 선정하여 그 의미를 해석하고 평석하였다. 선정한 판례들은, ① 법인의 ｢지방자치법｣ 상 ‘주민’의 해당 여부(대법원 2022. 4. 14. 선고 2020두58427 판결), ② 자치재정권의 존중과 위임입법의 한계(대법원 2022. 4. 14. 선고 2020추5169 판결), ③ 임용권자의 인사재량권의 범위(대법원 2022. 2. 11. 선고 2021도13197 판결), ④ ｢국가공무원법｣ 상 직위해제의 의의 및 직위해제처분의 유효기간(대법원 2022. 10. 14. 선고 2022두45623 판결), ⑤ 개발이익의 배제를 위한 비교표준지 공시지가의 기준일을 결정하기 위한 공고·고시의 방법(대법원 2022. 5. 26. 선고 2021두45848 판결), ⑥ 도시정비법상 총회의결에 있어서 ‘직접 출석’의 취지와 인정 범위(대법원 2022. 5. 12. 선고 2021두56350 판결), ⑦ 주택재건축정비사업조합과 조합원 간의 개별적인 약정의 구속력 및 그러한 약정을 위반한 경우 신뢰보호원칙을 통한 구제(대법원 2022. 7. 14. 선고 2022다206391 판결), ⑧ 임기가 만료된 학교법인 이사의 긴급처리권과 임시이사의 선임(대법원 2022. 8. 25. 선고 2022두35671 판결), ⑨ 판단여지에 대한 존중과 입증책임(대법원 2022. 9. 16. 선고 2021두58912 판결) 등에 관한 것이다.

This study aims to review the contents and meanings of 9 notable precedents in the field of individual administrative law which were decided in the Supreme Court in 2022. The precedents selected are as follows: ① Whether a corporation falls under a ‘resident’ under the ｢Local Autonomy Act｣(Supreme Court Decision 2020Du58427 Decided April 14, 2022), ② Respect for local financial autonomy and limitations of delegated legislation(Supreme Court Decision 2020Chu5169 Decided April 14, 2022), ③ Scope of discretionary authority over personnel of a person with appointing authority(Supreme Court Decision 2021Do13197 Decided February 11, 2022), ④ Significance of release from position under the ｢State Public Officials Act｣ and validity period of release from position(Supreme Court Decision 2022Du45623 Decided October 14, 2022), ⑤ Method of public announcement and notification to determine the base date of the official land price of the officially announced price of representative land for the exclusion of development profits(Supreme Court Decision 2021Du45848 Decided May 26, 2022), ⑥ Purpose and scope of recognition of ‘attendance in person’ in a resolution in a general meeting under the ｢Act on the Improvement of Urban Areas and Residential Environments｣(Supreme Court Decision 2021Du56350 Decided May 12, 2022), ⑦ Binding force of individual agreements between an association for a housing reconstruction and improvement project and its members, and relief through the principle of protection of trust in case of violation of such agreements(Supreme Court Decision 2022Da206391 Decided July 14, 2022), ⑧ Right to measures for urgency of directors of a school corporation whose term of office has expired and the appointment of temporary directors(Supreme Court Decision 2022Du35671 Decided August 25, 2022), ⑨ Respect for margin of judgement and burden of proof(Supreme Court Decision 2021Du58912 Decided September 16, 2022).
