Evaluation of the Three Years Implementation of Bargaining Agent Determination System, and the Other Alternatives

It's been three years since the long-awaited trade union pluralism at the enterprise level got introduced and the bargaining agent determination system took effect accordingly in July 1, 2011. Overall, considering the concerns beforehand, the new system seems to be settling down smoothly in the workplace. This study evaluates the past three years of enforcement of the trade union pluralism at the enterprise level and the bargaining agent determination system, and suggests institutional alternatives. This study especially focuses on the legal issues that occurred due to the lack of consideration of coordination between the Trade Union and Labor Relations Adjustment Act and the bargaining agent determination system during the revision of the Act. This study then suggests institutional alternatives for the parts that could not be or are difficult to be handled through interpretation of the Act. Specifically, this study presents problems surrounding the joint representative body system under bargaining representative mechanism, the method of calculating members of unions, the relation between supra-enterprise level unions such as industrial trade unions and collective bargaining, the maintenance period for representative union, and the bargaining unit separation system among unions, and proposes institutional options that can help to function more efficiently in industrial relations in Korea.
